Hello, Bart.  Regarding the irrigation issues, I have not been able to get =
input from Irrigators, Inc. yet.  But I have gotten enough general input fr=
om other sources that I think I have a good idea of what we need.  Subject =
to final confirmation from Irrigators, Inc., R&G would find the following a=
dditional terms to be acceptable:


  1.  Along the west property boundary, in the existing recorded 15' irriga=
tion easement, we need a new culvert for irrigation water supply from the n=
orth to the south.  Size to be confirmed, but I expect 15" will be adequate=
.
  2.  Along the east property boundary, retain and protect the existing bur=
ied tail water pipe that runs from north to south.
  3.  Easement rights to be prepared and recorded for these two items.
  4.  The Port will bear the cost of the forgoing, including drafting and r=
ecording.  All final documentation to be mutually agreeable.
  5.  The Port will agree that R&G and its successor(s) may continue to far=
m the entire 10-acre parcel, including the right of way area, through the 2=
024 alfalfa growing season.

The other terms will be as outlined in the Port's prior offer, specifically=
:


  1.  The Port will pay $190,272 for the 47,568 SF of land in fee (the Port=
's acquisition area) at $4.00/SF.
  2.  The Port will pay $117,716 ($1.00/SF) for market impact Severance Dam=
age to the total remnant area of R&G's ownership south of the taking (117,7=
15 SF).
  3.  The Port will pay all closing costs.
  4.  The Port will pay an additional $5,000 to partially compensate R&G fo=
r the need to obtain a boundary line adjustment.
  5.  The Port will also pay the statutory $750 amount to partially reimbur=
se R&G for the cost of its appraisal.  We provided the appraisal invoice to=
 the Port on March 1, 2023, and requested payment of the statutory $750 amo=
unt.  Payment of that amount is overdue.

Please let us know whether this approach is agreeable in concept to the Por=
t.   I will continue to follow up with Irrigators, Inc., to obtain their co=
nfirmation.
