We were then asked t= o submit a formal written proposal, which we submitted to the HOA February. Over the following months we made many requests to receive a response from = the HOA to our fence proposal to no avail. I understand that we are all ne= ighbors, but in formal matters it is our practice to maintain one point of = contact, and to not usurp their position by going around them to their supe= riors just because we don't like an answer. I think that responding or calling them out for not being fa= ctual will likely just stir up issues. In short, take the win and build the= fence.

Hi Albert, thanks f= or you help in this matter.

Usually it is best = to just accept a win or loss and walk away, but we feel the urge to address= some of their points since, in all honesty, I am not sure who has known wh= at for how long.  Or who has been privy to the dozens of conversations and emails we have had trying to get a resp= onse.

 

Do you see anything= in this response that would be problematic or do you have other suggestion= s.  Maybe just give timeline and less other detail?  We also do n= ot want to put our neighbor Lee in a bad position, so maybe less would be better.  Let me know your thoughts..  Thi= s would be just a reply all email response to the one that Amy sent out so = it would be CC’d to all of her recipients.---

 

 

Hi Amy, thank you f= or the letter from the BOD approving our side yard fence proposal.

With regard to some= of your points in the letter.  We began our request with the HOA for = this fence last fall.   After it was surveyed in October, we rece= ived negative feedback regarding its location, so over a couple of months, and with a number of conversations with Lee, we all ca= me to an agreement regarding the best options for the fence placement. = ; We were then asked to submit a formal written proposal, which we submitte= d to the HOA February. 

Over the following = months we made many requests to receive a response from the HOA to our fenc= e proposal to no avail.  I understand that we are all neighbors, but i= n formal matters it is our practice to maintain one point of contact, and to not usurp their position by going around them= to their superiors just because we don’t like an answer.  Consi= dering that our original fence proposal required no variances from the CC&a= mp;Rs, we believed that waiting months for a response was giving sufficient allowance for work schedules, children, etc.  A= dditionally, we were told that the BOD ‘had the votes’ to add r= estrictions to the CC&Rs regarding fences, and that there would be no f= ormal decision from the BOD until after the HOA meeting.  Finally, after months of urging the matter along yet seemingly no closer, = we turned the whole matter over to our attorney to solicit a response.=
